Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the first respondent to conduct the enquiry an accordant with law on the basis of the petitioner's representation dated 18.03.2017 against the 2nd and 3rd respondents and staffs, nurses, technicians, Doctors, Nephrologists and department head of Nephrology department in Indira Gandhi Medical College and Research Institute, Puducherry, for causing death to the petitioner's wife Susila aged 72 years by medical negligence and deficiency of service and complete the enquiry within the time stipulated by this Court.

As seen from the earlier proceedings, the learned counsel for the petitioner has been repeatedly seeking adjournments in this matter. On various occasions, the matter was listed under the caption 'for dismissal" and only at the request of the https://hcservices.ecourts.gov.in/hcservices/

learned counsel for the petitioner, the dismissal caption was removed and adjourned thereafter. Even today, the learned counsel for the petitioner seeks time to get instructions. The Writ Petition is of the year 2017. No further indulgence can be shown to the petitioner any more. Therefore, it can now be inferred that the petitioner is not interested in prosecuting this Writ Petition. Accordingly, the Writ Petition is dismissed for non prosecution. No costs.
