C.M.P.Nos.26521, 26525 & 26527 of 2019 in A.S.No.300 of 2011 S.M.SUBRAMANIAM.,J These petitions are filed to condone the delay of 181 days in filing the petition to set aside the abatement caused due to the death of the sole appellant; to set aside the abatement caused due to the death of the appellant and to bring on record the legal heirs of the deceased appellant and rank them as Appellants 2 to 5. 2.This Court is satisfied with the reasons stated in the supporting affidavit. The petition in C.M.P.No.26527 of 2019 to condone the delay of 181 days in filing the petition to set aside the abatement caused due to the death of the sole appellant is allowed and the delay is condoned. The abatement caused due to the death of the appellant is set aside and C.M.P.No.26525 of 2019 is allowed.

Proposed Appellants 2 to 5 are ordered to be brought on record as legal representatives of the deceased appellant as Appellant 2 to 5 in the Appeal and the petition in C.M.P.No.26521 of 2019 is allowed. 18.12.2019 mrm Note: Office is directed to carry out the necessary amendment in the grounds of appeal.
