ORDER
This petition is filed to call for the records relating to the 27.03.2025 made in MC.No.50/2024 on the file of Family Court, Krishnagiri and set aside the same by allowing this Criminal Revision Petition.
2. The facts of the case is that the petitioner married the first respondent on 27.06.2009 as per Hindu rites and customs. Thereafter, there was some misunderstanding between them due to which the couples started to live separately. Hence the respondent wife filed MC.No.50/2024 on the file of Family Court, Krishnagiri and the same was allowed on 27.03.2025 with a direction to pay a sum of Rs.7,000/- as maintenance to the respondent and also
to pay the arrears of maintenance. Challenging the same the petitioner has come up with this petition.
3. The learned counsel for the petitioner that the respondent is a educated person and she worked in a private concern and in order to file the maintenance petition she has left the job. It is also stated that the petitioner is not educated and he himself depends upon his parents. Hence, prays to allow this petition.
4. The learned counsel for the respondent submits that there was default in payment of arrears of maintenance. He further submitted that even though all the assets stands in the name of the father of the petitioner, he is the only son and his family is getting more than 25 lakhs per year and living with sufficient means. Hence prays to dismiss this petition
5. Heard both sides and perused the materials available on record.
6. On a perusal of records it is seen that this Court vide order dated 06.10.2025 has directed the petitioner to pay a sum of Rs.6,000/- as monthly
maintenance and deposit a sum of Rs.50,000/- towards arrears of maintenance. The said order has not been complied by the petitioner.
7. In view of the above fact, that the petitioner has not complied with the conditional order passed by this Court, this petition stands dismissed. Consequently, the connected miscellaneous petition is closed. 18-11-2025 Index:Yes/No Speaking/Non-speaking order Internet:Yes To.
