This Petition has been filed seeking a direction to the learned Judicial Magistrate No.II, Kallakurichi to return the cash security deposited by the petitioners for the bail bond in C.C.No.26 of 2023 in Crime No.60 of 2022 on the file of the respondent police as per the direction in the order dated 19.04.2024 passed by this Court in Crl.O.P.No.10162 of 2022 of 2022.

Learned counsel appearing for the petitioner would submit that the petitioners were accused in Crime No.60 of 2022, registered by the respondent police for the offences under Sections 341 and 392 of IPC. The petitioners had filed a bail application during the investigation, and this Court, while granting bail to the petitioners had directed the petitioners to deposit a sum of Rs.50,000/- each in Crime No.60 of 2022 vide order dated 29.04.2022. In compliance of the said order, the petitioners had deposited a sum of Rs.50,000/- each to the credit of Crime No.60 of 2022. Subsequently, the respondent police had completed the investigation and the case was taken for trial in C.C.No.26 of 2023 on the file of the learned Judicial Magistrate No.II, Kallakurichi and the petitioners were shown as accused 1 and 2. vca trial Court had instructed the petitioners to get an appropriate order for the return of cash security deposited by the petitioners and thereby, the present petition has been filed.

3. The learned Government Advocate (Crl. Side) appearing for the respondent police would submit that the petitioners in compliance of the bail order condition dated 29.04.2022 had deposited a sum of Rs.50,000/- each and now, they have been acquitted by the trial Court by judgment dated 12.09.2024.

4. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) for the respondent Police and perused the materials available on record.

5. Taking into consideration of the fact that the petitioners were acquitted in the above said case, this Criminal Miscellaneous Petition is ordered. The learned Judicial Magistrate No.II, Kallakurichi is directed to return the cash deposited by the petitioners in Crl.O.P.No.10162 of 2022 of 2022 dated 29.04.2022.
