ORDER

The petitioner has filed the above Writ Petition praying for issuance of a Writ of Mandamus to direct the respondent to pay the petitioner interest at the rate of 18% per annum, for the period of delay from 01.05.2023 to 11.02.2025, in paying the amounts paid towards his terminal benefits, namely EPF Employees' Contribution, gratuity and encashment of leave/already surrendered Earned leave, within a time frame as may be fixed by this Court and without affecting his right to claim balance amounts towards those benefits.

The petitioner was appointed/working as Conductor in the respondentCorporation from 30.04.1998 and after completion of 25 years of service and finally working as Special Grade Conductor with Staff No.98CR2J06789 in the respondent-Corporation, he retired from service on 30.04.2023 on reaching the age of superannuation, but only after passing of more than 1.5 years, he has been paid with the terminal and pension benefits, without interest for the delayed payment of the same, and hence, the petitioner has filed the present Writ Petition to direct the respondent to pay the interest amounts.

3. Heard both sides and perused the materials available on record.

4. Taking into consideration the facts and circumstances of the case, a direction is issued to the respondent to determine the eligible benefits payable to 2 / 4

the petitioner and after determining that particular amount, to pay the same to the petitioner together with interest @ 6% per annum from the date on which the petitioner had retired from service, till the date of actual disbursement of the amounts.

5. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
