ORDER
The petitioner, who was arrested and remanded to judicial custody on 02.07.2025 for the alleged offence under Section 115(2), 126(2), 63(a), 64 of BNS in Crime No.177 of 2025 on the file of the respondent police, seeks bail.

The case of prosecution is that the defacto complainant is aged about 75 years and on 02.07.2025 at about 02.00 a.m., when she was sleeping in her house, the petitioner said to have trespassed into her house in an inebriated condition and though she alarmed by screaming, he tied up her hands, bitten her mouth and chess aggressively and committed rape on her. Hence, the complaint was registered against the petitioner.
3. The learned counsel appearing for petitioner submitted that he has been falsely implicated in this case as if he said to have committed rape of the defacto complainant. But, in fact, there is no specific overtact attributed against the petitioner and he is no way connected with the offence. He would submit that he has not at all committed any of offence as alleged by the respondent police and he will abide by any condition that may be imposed by this court. He would further submit that the investigation is almost completed and that the 2/5
petitioner has been suffering incarceration for more than 69 days from 02.07.2025. Hence, he prayed to grant bail to the petitioner.
4. The learned Government Advocate (Crl. Side) appearing for respondent would submit that the petitioner is arrayed sole accused. He would submit that when the defacto complainant, who is aged about 75 years was sleeping in her house, at the early hours, on the date of occurrence, he trespassed into her house in inebriated condition, tied her house, bitten her mouth and committed rape, due to which she was admitted in hospital, wherein she fell down and died. He would also submit that if he is released on bail, he would hamper the investigation and tamper the witnesses and the investigation is almost completed. However, he would vehemently opposed to grant bail to the petitioner.
5. On seeing the facts, it reveals that when the defacto complainant sleeping in her house, around 02.00 a.m., the petitioner in an inebriated condition trespassed into her house and committed rape. So, considering the gravity of offence committed by the petitioner and also the fact that investigation is still pending and if he is released on bail, there is possibility of tampering the witnesses and hampering the investigation, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
