salary (back wages) from 21.10.2004 to 30.06.2009 and pay full pension with its arrears forthwith based on order dated 13.09.2024 passed by 1st respondent and consequential Wage Revision orders dated 27.05.2024 and 23.10.2024, passed by the 2nd respondent.

ORDER

This Writ Petition is filed for issuance of a writ of mandamus, directing the respondents to consider and take appropriate action on the representations, dated 20.06.2023, 02.01.2024, 18.03.2024, 08.07.2024, 08.07.2024, 30.09.2024, 11.12.2024, 11.12.2024, 16.12.2024, 24.04.2025, 24.04.2025, 09.06.2025, 19.08.2025 and 01.09.2025, submitted by the petitioner and thereby direct them to disburse all his retirement benefits including arrears of salary (back wages) from 21.10.2004 to 30.06.2009 and pay full pension with its arrears forthwith based on order dated 13.09.2024 passed by 1st respondent and consequential Wage Revision orders dated 27.05.2024 and 23.10.2024, passed by the 2nd respondent.

2. The case of the petitioner is that he joined the services of the

respondent Board as Cashier on 31.05.1974 and was promoted to the post of Inspector of Assessment on 28.05.1989 and further as Supernumerary Revenue Inspector on 11.12.2002. While so, he was issued with a memo by the second respondent on 21.10.2004 and placed under suspension for the charges of misappropriation and irregularities in collection and remittance of Board's money. Thereafter, he was issued with a charge memo on 16.06.2005 and disciplinary proceedings were also initiated against him. During the inquiry, the charges were proved against him, pursuant to which, he was removed from service. Aggrieved by the same, the petitioner filed W.P.No.25101 of 2014 before this court and the said writ petition was disposed of on 22.09.

2022, remitting the matter to the respondents for fresh inquiry, by furnishing all the documents that were relied upon by the respondents to the petitioner. Nevertheless, the respondents prolonged the disciplinary proceedings. The petitioner submitted several representations to the respondents, as cited above, requesting for withdrawal of charge memo, sanction of back wages, payment of retiral benefits and disbursement of pension. In the meantime, on 30.03.2024, the first respondent appointed an enquiry officer to pursue disciplinary proceedings and on 27.05.2024, a wage revision order was passed, granting only partial monetary benefits. Thereafter, the petitioner submitted further representations, including the one, dated 01.09.

of salary and other consequential benefits. However, there is no action by the respondents. Hence, he has come before this Court by way of this Writ Petition.

Learned counsel for the petitioner would submit that in the disciplinary proceedings, the petitioner had been absolved and he was allowed to retire and the respondents were also directed to settle the monetary benefits to the petitioner. However, the respondents have not settled the monetary benefits to the petitioner so far. He would further submit that the petitioner submitted several representations to the respondents and the last of which was made on 01.09.2025, which has not been considered so far.

4. Per contra, learned standing counsel for the respondents would submit that the petitioner has been convicted in a criminal case.

5. Heard the learned counsel for the petitioner and the learned Standing Counsel for the respondents.

6. It appears that the petitioner has been cleared in the departmental proceedings and a representation, dated 01.09.2025, has also been submitted by the petitioner to the respondents to settle the terminal benefits. However, the same has not been considered.

7. In view of the above, without going into the merits of the case, the first respondent is directed to consider the representation of the petitioner,

dated 01.09.2025, and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of copy of this order.

8. Writ Petition is disposed of accordingly. No costs. 22.09.2025 NCC :
