Prayer: Petition is filed under Article 226 of the Constitution of India, seeking Writ of Mandamus, directing the 3rd respondent to sanction and disburse the arrears of annual increments from July 2023 to till date and also to pay the balance subsistence allowance of Rs.28,187/- to the petitioner along with an interest thereon at 24 percentage per annum based on his representation dated 14.08.2025 within reasonable time.

ORDER

The Writ Petition is filed for the relief of a Mandamus directing the 3rd respondent to sanction and disburse the arrears of annual increments from July 2023 to till date and also to pay the balance subsistence allowance of Rs.28,187/- to the petitioner along with an interest thereon at 24 percentage per annum based on his representation 2/6

dated 14.08.2025 within reasonable time.

2. The petitioner would submit that he is working as a PG Assistant (Economics) in the Government Boys Higher Secondary School, Kalavai, Ranipet. It is the case of the petitioner that based on a false complaint lodged by one Srinivasan, the petitioner was suspended from service from 09.11.2022 to 10.11.2023 by the 3rd respondent. During the said period of suspension, 50% of subsistence allowance amounting to a sum of Rs.59,164/- was paid to the petitioner except for the month of October 2023, for which month, only a sum of Rs.30,977/-was paid. Therefore, the petitioner claims the balance amount of Rs.28,187/-.

3. The petitioner would further submit that he was not provided with annual increments from July 2023. Therefore, the petitioner sent a representation on 14.08.2025 to the 3rd respondent to sanction and disburse the arrears of annual increments from July 2023 till date with interest at 24% p.a., and also to pay the balance subsistence allowance 3/6

of Rs.28,187/-. However, there is no response. Therefore, the petitioner is before this Court.

4.Heard the submissions made on either sides and perused the records.

5. It is seen that the petitioner having sent a representation on 14.08.2025 has immediately rushed to this Court seeking a mandamus. However, a direction is issued to the 3rd respondent to consider and pass orders on the representation of the petitioner, within a period of 12 weeks from the date of receipt of a copy of this order, in accordance with law and on its merits.
