ORDER

This Suo Motu case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.)No.618 of 2025.

2. This case is registered for alleged offences under Sections 323 and 365 of IPC. The incident occurred on 02.07.2013. In this case totally there are four accused. The mother case in C.C.No.218 of 2013 was tried against A3 and A4 and ended up in acquittal on 20.02.2019. It is also stated that the parties have also since and living in their respective families amicably, no useful purpose will be served in keeping the matter pending. Summons is not served for A1 and A2, even if the accused is brought to face trial and summons is served, it would impinge upon his right to a speedy trial. Due to the passage of time, a meaningful trial is unlikely, and no useful purpose would be served.

3. Accordingly, the case in C.C.No.600114 of 2017 of Additional Mahila Court JM Level, Dharmapuri Taluk, Dharmapuri stands quashed and this Suo Motu Transfer case is disposed of.

17.09.2025 rap electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
