ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025. 2.The case was registered in Cr.No.2180 of 1992 dated 22.12.1992 for the alleged offence under Section 366, 392 and 376 of Indian Penal Code, 1860. This occurrence was of the year 1992. On account of the grave offence of rape, the victim have moved out from the place and her present about is absolutely untraceable. Thirty three years have passed by, however, the case lingers in the Court at the warrant stage. It can be seen that when the victim has moved on and living in some other family in some other place and wants to forget the past even asking her consent or calling her for this case after 33 years would be injustice. The accused is also not traceable. However, since the offence is heinous in nature, instead of dragging the case, in exercise of power under the Article 226 of the constitution of India, the case shall be deemed to be closed if in any future event if the accused surfaces or if the defacto Page No.1 of 2 https://www.mhc.tn.gov.in/judis

rap complainant pumps and insist that the case to be reopened, the same can be done otherwise, the case can be treated as closed forever.

Accordingly, the case in C.C.No.500057 of 1999 on the file of the Additional Mahila Court JM Level, Dharmapuri Taluk, Dharmapuri shall stand quashed and this Suo Motu Transfer Case stand disposed of. 17.09.2025 rap electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
