Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the 1st and 2nd respondents to cancel the cancellation of settlement deed executed by the 3rd respondent dated 31.10.2014 registered as document No.11167 of 2014 on the file of the 1st respondent (Sub Registrar, Redhills) by cancelling the Settlement Deed dated 05.02.2014, registered as document No.1017 of 2014 on the file of the 1st respondent (Sub Registrar, Redhills) and not binding on the petitioner in respect of the property being the entirety of the house ground and premises comprised in Survey No.159/2B, 3 (Classified as dry land), situated in Bypass Road, G.N.T.

Road, Padiyanallur Village, Ponneri Taluk, Trivellore District, land of an extent of 2895 square-feet together with the superstructure comprising of Ground Floor and First Floor, the property being bounded on the North by- Balasubramaniam Chettiar property, South by-Street, East by-property settled in favour of Arumugam and West by-Bypass Road, G.N.T. Road, the property measuring East to West on the northern side 8+84 feet, on the southern side 12.8 feet on the Eastern side 48 feet and on the Western side 90 feet.

Mr. A. Palaniappan, learned counsel appearing for the petitioner, seeks the permission of this Court to withdraw the Writ Petition with liberty to file a Civil Suit before a competent Civil Court.

2. Recording the submission made by the learned counsel for the petitioner, the Writ Petition is dismissed as withdrawn. It is open to the petitioner to file a Civil Suit seeking for appropriate relief before the appropriate Court, in accordance with law. No costs. Consequently, the connected Miscellaneous Petition is closed.
