Application No. 9647 of 2019 is filed to amend the prayer in the plaint with regard to the date of communication of the order blacklisting the plaintiff.

2. I heard the learned counsel for the applicant and the learned counsel for the first respondent/Port Trust as well as the learned Advocate Commissioner.

3. The learned counsel for the applicant submitted that the date of communication of blacklisting was erroneously mentioned as 23.09.2019 instead of 21.09.2019. Therefore, he submits that the present application is filed to permit the applicant to make the amendment.

4. The learned counsel for the first respondent submits that he has no objection to this application being allowed. 5.Upon considering the submissions of the counsel and on 1/3

examining the affidavit in support of the application, it is clear that the applicant has made out the case to allow the said application. Accordingly, this application is allowed and the applicant is permitted to carry out the amendment of prayer "C" in the plaint in the manner specified in the schedule to the Judges summons.

6. The Advocate Commissioner submits that he has executed the warrant and filed a report dated 21.11.2019. He further submits that he has received the full remuneration in respect of his service. Therefore, nothing survives in Application No.8368 of 2019 and the said application is closed.

7. List the Application No.8369 of 2019 on 07.01.2020. 13.12.2019 bga 2/3
