ORDER
This Suo Motu case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.)No.618 of 2025.
2. This case is registered for alleged offences under Sections 376 of IPC. The incident occurred on 24.08.1996. The victim herself is present before the Court and submitted that she has grand children and she doesn't want to pursue the matter any further. The accused is already a proclaimed offender, however, Non Bailable Warrant could not be executed.
3. Even though normally this Court in serious offences will not go by the wish of prosecutrix, this case is an exception. Considering the fact that the matter is pending from the year 1996 and twenty nine years have gone by, no useful purpose will be served and no meaningful trial can be conducted especially when the defacto complainant also doesn't want to proceed the case further, I am of the view Page No.1 of 2 https://www.mhc.tn.gov.in/judis

rap that this is a fit case for exercise of the power under Section 482 of IPC and as such the case in P.R.C.No.500028 of 2001 is quashed and this Suo Motu Transfer case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
