PRAYER: Civil Revision Petition is filed under Article 227 of the Constitution of India, for a direction to the learned Subordinate Judge, Attur to dispose of the O.S.No.10 of 2012 within a time fixed by this Court.

O R D E R

This civil revision petition seeks for expeditious disposal of O.S.No.10 of 2012 on the file of the Subordinate Court at Attur.

2. When the matter came up for admission, I called for a report from the learned Subordinate Judge at Attur as to why the suit has been kept pending for more than 12 years. The learned Subordinate Judge has sent a report dated 28.11.2024 stating that applications are pending for impleading certain lis pendens purchasers.

3. Mr.S.T.Bharath Gowtham has filed a typed set of papers showing that, despite the orders passed in I.A.No.773 of 2016 restraining the defendants 1, 5 to 14 from alienating the property, they have 2/4

proceeded to do so. Therefore, he pleads that he has taken out an application to implead 46 persons as parties to the suit in I.A.No.3 of 2024. The report of the learned Judge confirms this fact and he states that I.A.No.3 of 2024 is listed for hearing on 16.12.2024 for completion of service on the proposed parties.

4. Taking into consideration the aforesaid circumstances, the learned Trial Judge is requested to dispose of I.A.No.3 of 2024 within three months from the date on which the service is completed on the parties in I.A.No.3 of 2024. Once the pleadings are complete on the side of the impleaded parties, the learned Judge shall expedite the trial at all stages.

5. With the above directions, the civil revision petition stands disposed of. No costs.
