PRAYER: The Habeas Corpus Petition is filed under Article 226 of the Constitution of India for the issuance of a Writ of Habeas Corpus, to direct the respondents 1 to 3 to produce the petitioner's minor son viz., M.Bavinamudhan, aged 6 years, before this Court, and hand over the custody to the petitioner.

ORDER

(The order of the Court was made by J.Nisha Banu,J.) This Habeas Corpus Petition has been filed by the mother of the detenu seeking to direct the respondents 1 to 3 to produce the petitioner's minor son viz., M.Bavinamudhan, aged 6 years, before this Court and hand over the custody to the petitioner.

2. According to the petitioner her minor son, Bavinamudhan, aged 6 years, is under the illegal custody of the 4th respondent and her fatherin-law/5th respondent. The 4th respondent is father of the detenu.

3. Today, the child/detenu, aged 71⁄2 is produced before this Court. The child/detenu is not in illegal detention. It is seen from the records

that there is matrimonial dispute between the petitioner and the 4th respondent and proceedings are pending before the Family Court. If at all the petitioner is aggrieved, she can approach the appropriate Forum for her remedy. Accordingly, the Habeas Corpus Petition is closed. (J.NISHA BANU, J.) (S.
