2. Counter affidavit has been filed objecting the reasons stated in the affidavit filed in support of the petition.

3. Considering the facts as well as the reasons stated in the affidavit filed in support of the petition, the delay of 16 days in filing the appeal is condoned, giving an opportunity to the petitioner. The Petition is allowed.
