This petition is filed to restore the criminal original petition in Crl.O.P.No.23851 of 2025 on the file of this Court which was dismissed for non-prosecution by order dated 29.08.2025.

2. Heard the learned counsel for the petitioner.

3. Learned counsel for the petitioner submits that since he was not able to get the next date of hearing, he was unable to appear before this Court on the earlier occasion and thus, his non appearance was neither wilful nor wanton.

4. Satisfied with the reasons assigned in the affidavit filed in support of this petition, this petition is ordered and Crl.O.P.No.23851 of 2025 is restored to file.

5. Registry is directed to list the same in the usual course.
