PRAYER:-Writ Petition filed under Article 226 of the Constitution of India, praying for an issuance of Writ of Mandamus, to direct the 1st respondent to pass an arbitration award on the petitioners appeals / claim petitions dated 12.10.2021 within a stipulated period of time, by appointing competent engineers / officials for assessing the value of the land measuring an extent of 1458 Sq. Mtrs. in 365/4 (New S. No 365A) at Jittandahalli Village, Palacode Taluk, Dharmapuri Distrct, by strictly following the procedure contemplated under section 26 to 30 of the Right to Fair compensation and Transparency in land acquisition, Rehabilitation and Resettlement Act (Central Act 30 of 2013) and also following the procedures contemplated under section 18 to 27 of the Arbitration and conciliation Act 1996.

ORDER

This writ petition has been filed by the petitioner seeking to direct the 1st respondent to pass an arbitration award on the petitioners appeals / claim petitions dated 12.10.2021 within a stipulated period of time, by appointing

competent engineers / officials for assessing the value of the land measuring an extent of 1458 Sq. Mtrs. in 365/4 (New S. No 365A) at Jittandahalli village, palacode Taluk, Dharmapuri Distrct, by strictly following the procedure contemplated under Section 26 to 30 of the Right to Fair compensation and Transparency in land acquisition, Rehabilitation and Resettlement Act (Central Act 30 of 2013) and also following the procedures contemplated under section 18 to 27 of the Arbitration and conciliation Act 1996. 2.Mr.P.Sathish, learned Additional Government Pleader, takes notice on behalf of the respondents 1 & 2 and Mr.Su.Srinivasan, learned Standing rd respondent. By consent of the parties, Counsel takes notice on behalf of the 3 the main writ petition is taken up for disposal at the admission stage itself. 3.Heard the learned counsel for the petitioner; the learned Additional Government Pleader appearing for the respondent 1 & 2 and learned Government Advocate appearing for the 3 rd respondent.

4.The grievance of the petitioner before this Court is that the 2 nd respondent acquired the lands from the petitioner for the purpose of laying Four-Way Road in the year 2018 and passed an award in Roc.23/2018/LA dated 20.09.2021 by fixing a very meagre value for the petitioner's land. Aggrieved over the same, the petitioner filed an appeal petitions dated 12.10.2021 under 3G (5) of National Highways Act, before the 1 st respondent for enhancement of compensation. However, till date the 1 st respondent has not passed arbitration award. Hence, the present writ petition has been filed to direct the 1 st respondent to pass arbitration award on the petitioner's appeal dated 12.10.2021. 5.Taking note of the above submissions and in view of the limited prayer sought for in this Writ Petition, without going into the merits of the case, this Court directs the 1 st respondent to consider the appeal dated 12.10.2021 filed by the petitioner and pass an award on merits and in accordance with law, within a period of eight weeks.
