ORDER

This Writ Petition has been filed seeking issuance of writ of mandamus, directing the 2nd Respondent to point out the patta limit of the petitioner's property in Survey Nos.42 and 43/2A1 of Varadharajapuram Village, Kundrathur Taluk, Kancheepuram District as per Patta No. 8648 acknowledged in Ref. No. 2023/ 0123 / 03 / 000020 dated 18.09.2023 issued by the 2nd respondent in time bound period.

2. Though the learned counsel appearing for the petitioner would submit that the petitioner made an online application for measuring the subject properties as early as on 18.09.2023, till date, no order has been passed. Hence, the present writ petition is filed.

3. The learned Additional Government Pleader appearing for the respondents would submit that the 2nd respondent will take necessary steps and appropriate direction may be issued to the 2nd respondent to complete the survey.

4. Heard the learned counsel appearing for the petitioner as well as the respondent and perused the material available on record.

5. In view of the submissions made, the 2nd respondent is directed to consider the petitioner's online application dated 18.09.2023 and complete the survey and lay the boundary stones within a period of twelve weeks from the date of receipt of a copy of this order, after issuing notice to the necessary parties. In the event boundaries pass through the third parties land other than the petitioner's land, it is made clear that the authorities concerned including the Police shall not indulge in any activities to take over the possession and handover to the petitioner without following the due process of law. It is for the petitioner to take appropriate steps, if at all any land is encroached as per the measurement by the third parties, by due process of law.
