Writ petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus calling for the records relating to Crime No.1073 of 2012 pending on the file of the 2nd respondent herein and quash the same and consequently direct any other prosecuting agency to

conduct fresh investigation of the crime committed in the occurrence dated 26.06.2012 at the residential property of the petitioner herein on the basis of the complaint dated 26.06.2012 and 01.09.2012 sent by the petitioner subsequently to the 1st and 2nd respondents herein and file final report as expeditiously as possible before the jurisdiction court as per law and to follow the dictum of Hon'ble Supreme Court in the case of State of MP Vs Mishrilal (Dead) others reported in (2003) 9 SCC 426 for the trial of cross cases.

O R D E R

The learned counsel appearing for the petitioner seeks permission of this Court to withdraw this petition and he has also made an endorsement to that effect.

In view of the endorsement made by the learned counsel for the petitioner, this Writ Petition is dismissed as withdrawn. No costs. Consequently, connected miscellaneous petition is closed.
