This Criminal Original Petition has been filed to direct the first respondent to take further action on the basis of the complaint given by the petitioner on 27.09.2022.

2. The petitioner, who subscribed to a chit with Sri Preethy Chit Funds in Vridhachalam, Cuddalore District, had lost his money. Similarly, several persons have been cheated by one Harikrishnan, Proprietor of the Sri Preethy Chit Funds. The petitioner had lodged a complaint in detail to the Inspector of Police, Economic Offence Wing (EOW), Cuddalore and with the Superintendent of Police, Cuddalore. Thereafter no action has been taken. Hence, the above petition.
3. Learned Additional Public Prosecutor submits that on the complaint of the petitioner a current file in C.No.167/DSP-EOW/CUD/2022 dated 27.12.2022 was initiated. During enquiry it was found that like the petitioner several persons, namely, (i) Christini, (ii) Suresh, (iii) Senthil, (iv) Siluvaidurai, (v) Daniel, etc. have been cheated to the tune of Rs.5,65,000/-. The premises of Sri Preethy Chit Funds was found locked. The landlord of the property, namely, Dhanasekar was enquired, who informed that the Proprietor of Sri Preethy Chit Fund Private Limited had closed the business and he is not paying the rent regularly and now he is absconding. Further the registration of the chit was verified and found that Sri Preethy Chit Fund is Page No.2 of 4
unregistered one. The Deputy Superintendent of Police, EOW had sent a communication dated 27.12.2022 to the Superintendent of Police, Cuddalore informing that as per the circular in Rc.No.RA I(2) 2404643/2022 issued by the Director General of Police, the Economic Offence Wing can investigate the cases involving Rs.3 crores and more. In this case, it was found that Rs.5,65,000/- has been cheated by Harikrishnan. Hence, the petitioner was informed to lodge a complaint with the District Crime Branch, Cuddalore in this regard. He further submitted that it was informed to him that the petitioner had also lodged a complaint with Director General of Police, forwarded to District Crime Branch, Cuddalore and investigation is in progress.

Considering the submissions made and on a perusal of the material it is seen that the Deputy Superintendent of Police, EOW, Cuddalore had forwarded the report dated 27.12.2022 along with the petitioner's complaint to the Superintendent of Police, Cuddalore for further action. The petitioner is also at liberty to lodge a complaint before the District Crime Branch, Cuddalore, if he is not done so earlier, who thereafter to take appropriate action in this regard.
