Prayer: Writ Petition filed under Article 226 of the Constitution of India seeking issuance of Writ of Mandamus, directing the respondents 3 & 4 to extend the benefit of G.O.Ms.No.25, Personnel and Administrative Reforms Department dated 23.03.2015 to the petitioner and re-fix his pay scale and pensionary benefits on par with his juniors namely, Thiru. Edward, Primary School Headmaster, Pappini and Thiru.Ganesan Graduate Headmaster with effect from 01.06.2006 in the cadre of Primary School Headmaster and from 13.11.2009 in the cadre of Graduate Middle School Headmaster within the time frame. O R D E R

This writ petition has been filed seeking for a Writ of Mandamus directing the respondents to re-fix the pay scale and consequently to re-fix the pensionary benefits and pay the same to the petitioner.

2. It is seen from the records that the petitioner was appointed as a secondary grade Teacher in the year 1979 and he was awarded selection grade of Tamil Pandit in the year 1998. Thereafter, the petitioner was promoted as a Graduate Headmaster 1/2 https://hcservices.ecourts.gov.in/hcservices/

and posted at Avinashipalayam Pudur Middle school. The petitioner superannuated on 31.05.2010 from the Middle School. According to the petitioner, there is a pay anamoly and therefore re-fixation of pay must be made in accordance with G.O.Ms.25, dated 23.03.2015. The petitioner has made a representation to the respondents seeking for re-fixation of pay and for the consequential benefits. Since it has not been considered, the present writ petition has been filed before this Court.

3. Heard Mr.S.Balamurugan, learned counsel appearing on behalf of the petitioner and Mrs.V.Annalakshmi, learned Government Advocate appearing on behalf of the respondents.

4. Taking into consideration the facts and circumstances and also the limited relief that has been sought for in this writ petition, there shall be a direction to the 3rd respondent to follow up with his proceedings dated 04.11.2016 wherein, he had sought for a report from the 4th respondent with regard to the claim made by the petitioner and pass appropriate orders within a period of four (4) weeks from the date of receipt of a copy of this order. The petitioner is directed to make a fresh representation along with a copy of the proceedings dated 04.11.2016 and a copy of this order to the 3rd respondent.

5. This writ petition is disposed off with the above direction. No costs.
