MR.M.SANKAR COMMON ORDER Before the trial Court, the plaintiff filed two applications: one to condone the delay in filing a petition to restore the suit, which was dismissed for default on 01.09.2021, and another to restore the suit. Both applications were allowed on merits by the trial Judge. Consequently, the suit was restored, and evidence has been adduced on the side of the plaintiff. Challenging the said orders, the defendant has filed the present revision.
2. Both the learned counsel appeared. The learned counsel for the respondent/plaintiff submitted that, after restoration of the suit, the plaintiff has adduced evidence and was cross examined by the defendant, and the matter is now posted for the defendant's evidence.
3. As on date, the orders have been complied with and the trial has already commenced; therefore, nothing survives for adjudication in this
revision. In the result, the civil revision petitions are dismissed as infructuous. However, the trial Court is directed to proceed with the trial and dispose of the suit on merits in accordance with law. Consequently, connected miscellaneous petition is closed. No costs.
