Respondent in both WPs PRAYER : Writ Petitions filed Under Article 226 of the Constitution of India praying to issue Writs of Mandamus, directing the respondent to dispose of the representations dated 7.3.2017 of the petitioners in so far as the claim to permit the petitioners to encash the accumulated earned leave standing to their credit as on 28.2.2015 and 30.6.2015 respectively, the date of their retirement from service, without any further delay. C O M M O N O R D E R The Grievances of the writ petitioners are that they were allowed to retire from service on their attaining the age of superannuation. However, the encashment of accumulated Earned Leave standing in the credit of the writ petitioners have not been settled. In this regard, the writ petitioners submitted their representations to the respondent on 7.3.2017 and the same is yet to be considered.

2. In view of the fact that the writ petitioners were allowed to retire from service without prejudice to the Department and the disciplinary proceedings are pending, the respondents have to consider the disbursement of encashment of Earned Leave as per the Rules in force.

Thus, without going into the merits of the matter, the respondent is directed to consider the representations submitted by the writ petitioners on 7.3.2017 and pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. The writ petitioners are directed to enclose the copy of the representation and all other relevant documents along with the order passed in these writ petitions.
