This Original Petition has been filed taking advantage of Section 372 of the Indian Succession Act, 1925 seeking Succession Certificate with respect to the securities which are share certificates at TATA Consumer Products Limited, which stood in the name of the father of the petitioner, Mr.N.Chidambaram Chettiar, who died intestate on 16.11.1997. The 1st respondent is the sister of the petitioner. The 2nd, 3rd and 4th respondents are the legal heirs of deceased brother of the petitioner. The 5th, 6th and 7th respondents are the legal heirs of yet another deceased brother of the petitioner. The respondents have given their consent affidavit. 2.After following due procedure, the petitioner was directed to tender evidence. Accordingly, the petitioner examined himself as PW-1.

The death certificate and legal heirship certificate of his father, Mr.N.Chidambaram Chettiar were marked as Exs.P1 and P2. The death certificate and legal heirship certificate of his two brothers were marked as Exs.P7 to P10. The document relating to the share certificates were marked as Exs.P3, P4 and P5. The death certificate of the mother of the petitioner was marked as Ex.P6.

smv 3.Taking into consideration the nature of evidence adduced and the documents produced, this Original Petition stands allowed. The Succession Certificate may be issued in favour of the petitioner in accordance with the rules.
