PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the 2nd and 3rd respondents herein not to harass the petitioner Rizwan S/o. O R D E R

This petition has been filed to direct the 2nd and 3rd respondents herein not to harass the petitioner and his family members without due process of law.

2.Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor appearing for the respondents and perused the materials available on record. 3.Learned counsel for the petitioner has submitted that due to civil dispute, one Chinnaraju who is the retired Tahsildar gave a complaint before the 3rd respondent and based on the said complaint, the 3rd respondent is unnecessarily harassing the petitioner.

4.Learned Additional Public Prosecutor appearing for the respondents has submitted that one Chinnaraju has lodged a complaint against the petitioner and only for enquiry purpose, he was called and he was not subjected to any harassment. 5.Considering the aforesaid submissions, the 3rd respondent is directed to conduct the enquiry only with the complainant and if the said enquiry reveals any cognizable offence, he can register a case and thereafter, proceed in accordance with law and instead of that he should not unnecessarily harass the petitioner.

6.With the aforesaid direction, this Criminal Original Petition is disposed.
