The petitioner who apprehends arrest for the alleged offence punishable under Section 420 read with Section 34 of IPC in Crime No.0153 of 2019, seeks anticipatory bail.

2. The case of the prosecution is that in the year of 2017, the petitioner along with the other accused colluded together and on false promise received a sum of Rs.10 lakhs from the defacto complainant for getting visa to Canada and subsequently cheated him. Hence, the criminal case has been registered against the petitioner. Now, apprehending arrest, the present petition has been filed.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is no way connected with the alleged offences and he is an innocent person. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Public Prosecutor (Puducherry ) submitted that in the year of 2017, the petitioner along with the other accused colluded together and received a sum of Rs.10 lakhs from the defacto complainant for getting visa to Canada and subsequently cheated him. He further submitted that if the petitioner is granted anticipatory bail, there will be possibility of tampering the witnesses, hampering the investigation and abscondance. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case, gravity of the offence, possibility of abscondance, and detail investigation in this case is required, this Court is not inclined to grant the relief sought for in this petition.

6. Accordingly, this Criminal Original Petition for anticipatory bail stands dismissed.
