The orders passed by the respondent herein in Office Memo No.21/BOI/FRRO/CHN/SC/2022-170-6607 dated 21.11.2022 and Office Memo No.21/BOI/FRRO/CHN/SC/2022-174-6859 dated 05.12.2022, are put under challenge in the present Writ Petition.
2. Heard Mr.J.Saravanavel, learned counsel for the petitioner and Mr.V.Madana Gopal Rao, learned counsel appearing on behalf of the respondent.
3. The learned counsel for the petitioner submitted that the petitioner had filed this petition challenging the show cause notices of the respondent, dated 21.11.2022 and 05.12.2022, wherein it was stated that on failure to give an explanation in regard to non filing of C Form within the prescribed time, action will be taken against the petitioner under Section 14C of the Foreigners Act, 1946 and Section 174 of Indian Penal Code. He further submitted that the notices impugned are without jurisdiction, illegal and violative of Articles 14 and 21 of the Constitution of India and thus, prayed to quash the same.
4. The learned standing counsel appearing on behalf of the respondent submitted that the respondent has decided to drop further action as against the petitioner in respect of the show cause notices dated 21.11.2022 & 05.12.2022 and the same was communicated to the petitioner.
5. In view of the submissions of the learned Standing counsel for the respondent and since action has been dropped against the petitioner by the respondent in respect of the impugned show cause notices, this Writ Petition stands closed. Consequently, connected Miscellaneous Petition is also closed.
