ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. This case is registered for the alleged offences under Sections 302 r/w 120 (B), 109 & 34 of IPC. The occurrence happened in the year 2009. It is a gruesome murder and however, it can be seen that the accused 1 to 3 have already died. No service was effected on A4. Currently, warrant is pending and accordingly the matter is pending for the past sixteen (16) years. The defacto complainant who are the witnesses are also not to be traced out in the addresses.

3. Under the said circumstances, no useful purpose will be served by keeping the matter pending. Therefore, this Court finds it to be a fit case to invoke its extraordinary power under Article 226 of the Constitution of India and Section 482 of Code of Criminal Procedure, 1973. This case is treated to be closed with liberty that if the accused re-surfaces on any future date, the same shall be re-opened and the case be conducted considering the fact that the murder is a gruesome one.

4. Accordingly, the case in PRC.No.34/2023 of District Munsif Cum Judicial Magistrate, Denkanikottai Taluk, Krishnagiri, stands closed. This Suo Motu Transfer Case is disposed of.

22.09.2025 rap electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
