This writ petition has been filed seeking for a Mandamus directing the second respondent herein to remove the remarks reflected in Encumbrance Certificate and to pass orders within a time frame.

2. Learned counsel for the petitioner submits that the petitioner made a representation on 09.11.2023 seeking to remove the remarks reflected in the Encumbrance Certificate. The main grievance of the petitioner is that even though the representation has been made on 09.11.2023, till date the second respondent has not taken any action on the said representation.

3. Learned Additional Government Pleader appearing for the respondents submits that the representation of the petitioner dated 09.11.2023 will be considered as expeditiously as possible.

Therefore, without expressing any view on the merits of the matter, this Writ Petition is disposed of with a direction to the respondents to consider the representation dated 09.11.2023, after giving due opportunity of hearing to writ petitioner as well as rival claimants / interested parties, if any and pass orders on merits and in accordance with law. Such exercise shall be done by the respondents within a period of three months from the date of receipt of a copy of this order.
