Civil Revision Petition filed Under Article 227 of Constitution of India, praying to direct the learned Principal District Judge, Erode to number the unnumbered O.S.No. of 2023 (CFR No. 5135 of 2023) on the file of the learned Principal District Judge, Erode.

The petitioner has filed this revision petition to direct the learned Principal District Judge, Erode to number the unnumbered O.S.No. of 2023 (CFR No. 5135 of 2023) on the file of the learned Principal District Judge, Erode.

2. Before the trial Court she filed a suit to declare her name as Savithri, but she was used to call as Shanthi. Therefore, while purchasing the property her name was wrongly mentioned as Shanthi. In fact her name is Savithri so she had filed the present revision petition to declare her name as Savithri and also to declare that she is the absolute owner of the suit property as per the sale deed dated 20.12.1999. The plaint was returned by the learned trial Judge on the ground that no proof was attached to that effect and she has also signed as 'Santhi" in the sale deed. Challenging the same the revision petitioner has preferred this revision.

3. The learned counsel for the revision petitioner submitted that the original name of the revision petitioner is Savithri and her nick name is Shanthi.

4. On a perusal of the records, it shows that, the sale deed registered by the petitioner in document No.1546 of 1999, dated 20.12.1999, is also stands in the name of Shanthi and she has also signed in the sale deed as Shanthi only. If at all her original name is Savithri, she ought to have signed as 'Savithri' in the Sale deed instead of Shanthi. Therefore, the learned trial Judge has rightly observed and concluded the findings in accordance with law, which needs no interference by this Court.

5. Accordingly, this Civil Revision Petition is dismissed. No costs. 13.12.2023 Index : Yes/No Speaking/Non Speaking order rri To
