(W5 P.S.CRIME NO.1 OF 2013) Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in Criminal APPEAL No.88 OF 2017 on the file of the High Court, the High Court will be pleased to suspend the sentence of imprisonment imposed on him vide the judgment of conviction dated 23.12.2016 passed by the Sessions Judge, Magalir Neethimandram at Chennai in the above Sessions Case No.5 of 2014 and enlarge the petitioner on bail on such terms and conditions, pending disposal of the Criminal Appeal No.88/2017.
Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl.A.No.88 of 2017 on the file of the High Court and upon hearing the arguments of M/S.C.PRABAKARAN, Advocate for the petitioner and of Mrs.SARATHA DEVI.V. Government Advocate (Crl.Side) on behalf of the Respondent the court made the following order:- This miscellaneous petition has been filed seeking to suspend the sentence imposed on the petitioner by judgment dated 23.12.2016 in S.C.No.5 of 2014 by the learned Sessions Judge (Mahalir Neethimandram, Chennai), Court of Sessions, Chennai, and enlarge the petitioner on bail pending disposal of the above criminal appeal.
2. Heard both sides.
3. Having regard to the facts and circumstances of the case, this miscellaneous petition is allowed and the substantive sentence of imprisonment alone is suspended and the petitioner is released on bail on condition that the petitioner shall deposit a sum of Rs.10,000/- (Rupees ten thousand only) to the credit of S.C.No.5 of 2014 on the file of the Sessions Judge (Mahalir Neethimandram, Chennai), Court of Sessions, Chennai, and further the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each https://hcservices.ecourts.gov.in/hcservices/
for a like sum to the satisfaction of the Magalir Neethimandram, Chennai. Further, the petitioner shall appear before the trial Court on the first working day of every month at 10.30 a.m until further orders.
