ORDER

This Application is filed seeking to condone the delay of 15 days in filing the Application to set aside the order dated 25.09.2024 passed by the learned Master Court in E.P. No.88 of 2019.

2. I have gone through the affidavit filed in support of the Application as well as the impugned order of the learned Master.

3. The learned counsel for the Applicant would take me through the affidavit assigning reasons for the delay. It appears Copy Application was made ready only on 19.10.2024 and the Appeal was filed immediately without delay. Though the Appeal ought to have https://www.mhc.tn.gov.in/judis

been filed from the date of the order of the learned Master and not from the date of receipt of the Certified copy, considering the delay being only 15 days, no serious prejudice would be caused to the respondent.

4. Though the respondent seeks time to file a counter to oppose the delay Application, I am satisfied that the submission of the learned counsel for the Applicant that the delay is not wilful or wanton and the reasons set out are also acceptable and satisfactory. In view of the same, delay of 15 days is condoned and this Application is ordered accordingly.
