ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025. 2.This case in Cr.No.61 of 2019 dated 09.02.2019 was registered for the alleged offences under Sections 379 of the Indian Penal Code, 1860. It is reported that the property has been recovered and is in the custody of the Court. As and when required, the defacto complainant shall approach and get return of property. The defacto complainant is presently not traceable. The Accused has been attending the proceedings regularly.

3.Considering the nature of allegation, the antecedents of the accused, it is evident that even if the accused is continuing to face trial, it would impinge upon his right to a speedy trial. Due to the passage of time, a meaningful trial is unlikely, and no useful purpose would be served. Page No.1 of 4

Accordingly, the case in C.C.No.279 of 2019 on the file of the Judicial Magistrate Court, Avinashi, Avinashi Taluk, Tiruppur shall stand quashed and this Suo Motu Transfer Case stand disposed of. 26.09.2025 shl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
