O R D E R

This Writ Petition has been filed seeking for issuance of Writ of Mandamus to direct the first respondent/independent agency CB-CID to enquire into the custodial torture of the petitioner herein at Thittagudi All Women Police Station, Cuddalore District by considering the representation of the petitioner dated 07.11.2024 in accordance with law.

2. Heard both sides.

It is the case of the prosecution that on 04.11.2024, the de-facto complainant, the fourth respondent herein lodged a complaint to the second respondent-Police alleging that the petitioner herein has given a false promise that he will marry her and they had love affair for the past 16 years, subsequently, the petitioner/accused refused to marry her. 2/5

Hence, the complaint.

Learned Additional Public Prosecutor appearing for the first respondent submitted that based on the complaint given by the de-facto complainant, initially C.S.R. was assigned in C.S.R.No.334 of 2024. During enquiry, both the parties amicably settled issue and the petitioner agreed to marry the de-facto complainant and hence, the respondentPolice closed the C.S.R.No.334 of 2024 on 05.11.2024. He further submitted that after filing of this writ petition, the petitioner and the fourth respondent herein got married and he has also produced the photos taken at the time of marriage.

5. Considering the facts and circumstances, this Court finds that there is no evidence of custodial torture to the petitioner as the petitioner has married the fourth respondent/de-facto complainant after filing of this writ petition and hence, nothing survives for adjudication in this petition.

6. Accordingly, this Writ Petition is disposed of. There shall be no 3/5

order as to costs. Consequently, connected miscellaneous petition is closed.
