CMP.Nos.496, 497 & 498/2023 in AS.No.814/2009 S.S.SUNDAR, J., and P.B.BALAJI, J., [Order of the Court was made by S.S.SUNDAR, J.,] These petitions are filed to condone the delay of 37 days in filing the petition to set aside the abatement caused due to the death of the 3rd respondent in the appeal ; to set aside abatement and to bring on record, the legal representatives of the deceased 3rd respondent as respondents 7 to 9 in the above appeal in AS.No.814/2009.

2.Despite notice being served on the proposed respondents, there is no representation for them.

3.The petitioner has given reasons to the satisfaction of this Court explaining delay in the affidavit filed in support of this petition. 4.Since the relationship of the parties and the facts are not in issue, the above Civil Miscellaneous Petitions are ordered.
