PRAYER : Writ Petition has been filed under Article 226 of the Constitution of India, to issue Writ of Mandamus, directing the respondents 1 to 3 issue the police protection to the temple festival of Arulmigu Unjapalayam Karuppannasamy Thirukoil, Mohanoor Taluk, Namakkal District dated 01.12.2023 to 03.12.2023, as per the 4th respondent proceedings dated 14.11.2023 and the petitioner representation dated 16.11.2023. ORDER

The Karthikai Month festival of A/M. Unjapalayam Karupanna Swamy Thirukoil, Mahanur Taluk, Namakkal District is to be conducted on 01.12.2023 to 03.12.2023. There is a dispute between the hereditary trustees and the local villagers which has led to filing of Civil Suits by the villagers as against the hereditary trustees who are petitioners herein.

2. The Application filed by the hereditary trustees to reject the said suit was dismissed. Aggrieved by that, the hereditary trustees preferred Revision Petition before the High Court and the same is pending. This Court has also ordered status quo, as far as the civil suit is concerned. Meanwhile, considering the prevailing situation, the learned Joint Commissioner of HR & CE, who is Page No.2/4

incharge of the said temple had requested the Police to provide adequate protection for conducting the festival and that request dated 14.11.2023 is under consideration by the respondent police. Meanwhile, the hereditary trustees have filed the present petition seeking Police Protection for conducting the festival as per the proceedings of the Joint Commissioner dated 14.11.2023 and representation of the petitioner dated 16.11.2023.

3. The learned Government Advocate (Crl.Side) submits that based on the situation and on the request made by the Joint Commissioner, necessary protection will be provided for conducting the temple festival slotted to be carried on 01.12.2023 to 03.12.2023.
