.. Respondents The writ petition is filed under Article 226 of the Constitution of India praying for the issue of a writ of certiorari to call for the records on the file of the second respondent in his proceedings in TNGST No.6241097/2003-2004 dated 16.7.2004 and quash the same.

ORDER

Heard Mr.S.Rajasekar, learned counsel for the petitioner and Mr.S.Kanmani Annamalai, learned Additional Government Pleader for the respondents.

The petitioner has filed this writ petition challenging the notice issued by the second respondent, dated 16.07.2004, informing the petitioner to submit the returns and to pay the tax due thereon.

During the course of the argument, the learned counsel for the petitioner submits that the petitioner may be granted permission to submit reply to the impugned notice and face the proceedings before the second respondent.

Accordingly, the writ petition is disposed of by granting the petitioner thirty days time from the date of receipt of copy of this order to file objections to the impugned notice dated 16.07.2004 and after their objections are filed, the second respondent is directed to afford an opportunity of personal hearing to the petitioner and proceed in accordance with law. The order of interim stay granted earlier stands vacated. No costs.
