This petitioner came before this Court seeking direction that the police is harassing him by causing summons under Sections 91 and 160 Cr.P.C., based on the complaint given by one Senthilkumar. 1/4

The learned Government Advocate (Crl.Side) appearing for the State submits that earlier this Court directed the petitioner to appear before the Investigating Officer vide order dated 30.10.2023. Though he did not appear and responded to the earlier summons issued, the petitioner has not appeared before the Investigating Officer on 04.11.2023 as directed by this Court. Since he did not comply the direction of this Court, summons under Sections 91 and 160 Crl.P.C., dated 17.11.2023 directing the petitioner herein to appear before the Investigating Officer with all relevant documents was served. But the petitioner instead of appearing before the Investigating Officer in response to the summons on 21.11.2023, had sent a letter dated 18.11.

2023 by registered post stating that the Court directed him to appear before the Investigating Officer, but he did not received any summons on that day. Therefore, he cannot appear before the Investigating Officer without mentioning details about the case number. After shooting up this, the petitioner is again before this Court alleging that the police is harassing him and seeks to quash the summon dated 17.11.2023. 3.

This Court on perusing the record finds that the petitioner deliberately avoiding summons and making of false protest to evade 2/4

investigation. Hence this Criminal Original Petition is dismissed. It is open to the respondent police to take necessary action to secure the petitioner and complete the investigation.
