PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents herein to consider and dispose of petitioner's representation dated 27.02.2024 wherein the petitioner sought reworking of his pay and allowances as per the pay drawn by him as on 24.07.2000 and make payment after adjusting the amount already paid to him with interest and costs within a time frame and to pass orders.

By consent of learned counsel on either side, this writ petition is taken up for final disposal at the stage of admission itself.

This petition is filed seeking to issue a Writ of Mandamus directing the respondents herein to consider and dispose of petitioner's representation dated 27.02.2024 wherein the petitioner sought reworking of his pay and allowances as per the pay drawn by him as on 24.07.2000 and make payment after adjusting the amount already paid to him with interest and costs within a time frame and to pass orders.
3. The facts of the case is that a charge memo was issued by the Deputy Commissioner of Police, Guindy to the petitioner who is working as a Grade I Police Constable. Challenging the same several writ petitions and writ appeals were filed by the petitioner regarding the said issue. However, the issue reached finality by the orders passed by this Court in 17.02.2021 in W.P.No.14407 of 2012, wherein there was a direction to the respondents to treat the period of absence both during the suspension and during the dismissal as duty period for all purposes except for backwages. The said order has not been complied with, due to which the 2/5
petitioner gave representation to the respondents on 27.02.2024, but the same was not considered till date. Hence, this petition.
4. The learned counsel for the petitioner submitted that the petitioner retired on 31.07.2022. He further submitted that it would be suffice if this Court issues a direction to the respondents to consider petitioner's representation dated 27.02.2024 and pass orders.
5. The learned Special Government Pleader appearing for the respondents submitted that they will consider the case of the petitioner and pass orders on merits and in accordance with law.
6. Considering the facts and circumstances of the case and the limited relief sought for by the petitioner, this Court, without expressing any opinion on the merits of the case, directs the respondents to consider the petitioner's representation dated 27.02.2024 and pass orders on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.
7. With the above observations this writ petition stands 3/5
disposed of. No order as to costs.
