ORDER

The relief sought for in this writ petition is to direct the respondents herein to forthwith schedule and conduct the survey and boundary demarcation of the petitioner's land in Survey Nos.148/1 and 148/3A2, Joint Patta Nos.634 and 1115 respectively, situated at Puthiragoundanpalayam Village, Pethanaickenpalayam Taluk, Salem District, based on e-Challan payments dated 31.07.2024 and 27.06.2025, as well as petitioner's representation dated 27.06.2025.

2. Mr.C.Jayaprakash, learned Government Advocate takes notice on behalf of the respondents 1 & 2. By consent of both the parties, this writ petition is taken up for final hearing at the admission stage itself.

3. The case of the petitioner is that the property comprised in Survey No.148/1, Joint Patta No.634 and Survey No.148/3A2, Joint Patta No.1115, situated at Puthiragoundanpalayam Village, Pethanaickenpalayam Taluk, Salem District belongs to petitioner. The 2/6

petitioner made an online applications dated 31.07.2024 and 27.06.2025 to survey the land and boundary demarcation along with relevant documents and requisite fee. However, the same was not conducted by the respondents. Thus, the petitioner sent a representation dated 27.06.2025 to the respondents, to conduct survey and boundary demarcation in respect of the aforementioned survey numbers. However, till date, no orders was passed by the respondents. Hence, the petitioner has come forward with the present writ petition.

4. Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that, it would suffice, if this Court issues direction to the respondents 1 & 2 to consider the petitioner's representation dated 27.06.2025 to survey the property and fix the boundaries.

5. Learned Government Advocate appearing for the respondents submitted that the petitioner's representation dated 27.06.2025 would be considered and appropriate orders passed, within a time frame that may be fixed by this Court.

6. Heard the learned counsel on either side and perused the materials available on record.

Considering the limited relief sought for by the learned counsel for the petitioner, this Court without going into the merits of the case, directs the respondents to conduct a survey and demarcate the boundary in respect of aforesaid petitioner's property, after giving due notice and opportunity of personal hearing to the petitioner as well as aggrieved persons, if any, within a period of four weeks from the date of receipt of a copy of this order. It is needless to say, in case of any obstruction being created by third parties, the second respondent is at liberty to approach the Police officials, in which case, the Police officials shall render assistance to the second respondent to carry out the aforesaid exercise.

With the aforesaid direction, this writ petition is disposed of. No costs.
