ORDER
This Writ petition has been filed seeking to direct the 1st respondent to review the petitioner's suspension order dated 02.09.2022 bearing proceedings No.DCS 2/32951/2022, in the light of the petitioner's representation dated 03.01.2024 and consequently, permit the petitioner to continue in service with all consequential service benefits.
2. Mr.Yogesh Kannadasan, learned Special Government Pleader takes notice on behalf of the respondents. In view of the consent expressed by the learned counsel on either side, this Writ petition is taken up for final disposal at the admission stage itself.
3. The case of the petitioner is that, he was appointed as a Record Clerk in Kallakurichi regulated market, by proceedings of the Secretary, South Arcot Market Committee, Cuddalore District in the year 1996 and after several promotions, the petitioner was given promotion as 2/6
Superintendent of Market, Thiruvennainallur Regulated Market in the year 2018. The petitioner has also received appreciation certificate for his unblemished service from the District Collector of Villupuram. While such being the case, the petitioner was placed under suspension, vide order of the 1st respondent dated 02.09.2022 bearing proceedings No.DCS 2/32951/2022 and he has been in temporary dismissal for a period of 1 1⁄2 years, despite the several requests made by him before the respondents seeking to review his suspension and to permit him to continue his service. However, as no action has been taken by the respondents, the petitioner has come up with this Writ petition.

Learned counsel for the petitioner submitted that, it would suffice, if this Court issues direction to the 1st respondent to review the petitioner's suspension order dated 02.09.2022 in the light of the petitioner's representation dated 03.01.2024 and to consequently, permit the petitioner to continue in service with all consequential service benefits. 3/6
5. Per contra, the learned Special Government Pleader appearing on behalf of the respondents submits that, the competent authority to consider the petitioner's claim is the 2nd respondent. However, no such representation has been made by the petitioner before the 2nd respondent, enabling him to take action in that regard.

In view of the above, this Court, without going into the merits of the case, directs the petitioner to make a fresh representation before the 2nd respondent within a period of two (2) weeks from the date of receipt of a copy of this order and upon such representation being made, the 2nd respondent shall consider the same and pass appropriate orders on merits and in accordance with law, within a period of twelve (12) weeks thereafter, after affording opportunity of hearing to the petitioner. 4/6
7. With the above directions, this Writ petition stands disposed of. No costs.
