PRAYER:Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code to modify the condition in so far as the petitioners to appear and sign in Court until questioning in C.C.No.121 of 2019 (Cr.No.5 of 2014 on the file of the respondent police) dated 18.11.2019 on the file of the Judicial Magistrate, Alandur in so far as the condition is concerned. O R D E R

The present petition if filed to modify the condition imposed by the Trial Court, which directed the petitioners to appear before it on daily basis.

2.The learned counsel for the petitioners submitted that the petitioners were not the named accused, that after filing the final report, the Court did not issue any summons and consequently the Non Bailable Warrant was issued to them. The petitioner surrendered and he explaining the state of affairs, the Trial Court was pleased to recall the Non Bailable Warrant on condition that the petitioners to appear before the Court on each and every day and should sign till the questioning and to cooperate for trial till framing of charges. have complied with the condition for the past 22 days. 3.This court is not able to ascertain the present state of affairs in as much as the Trial Court imposed condition, the petitioners is well advised to approach the Trial Court at the first instant for modifying the condition. Once the petitioners approaches the Trial court, the Trial Court may take a call on the matter on the same day, subject to the above condition, this petition stands closed.
