Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the respondents 1 to 4 to take necessary steps to remove the encroachments made by the 5th respondent, made in the pathway poromboke land in S.No.276/5 of Melacheri Village, Melmalayanur Taluk, Villupuram District, on the basis of the Form 7 notice dated 09.02.2022 issued to the 5th respondent by the 3rd respondent under Tamil Nadu Land Encroachment Act, 1905 and enable the village people free access to the said pathway.

ORDER

(Made by the Hon'ble Chief Justice) Heard Mr.V.Appaswamee, learned counsel for the petitioner and Mr.P.Muthukumar, learned State Government Pleader for respondents 1 to 4.

2. It is submitted by learned counsel for the petitioner that even notice under Section 7 of the Tamil Nadu Land Encroachment Act, 1905 is issued to the encroachers on 09.02.2022, however, the Government has not taken further steps.

3. Learned State Government Pleader submits that in case, further steps are not taken, then the Government would proceed ahead, in accordance with law, against the encroachments expeditiously.

4. In view of the said statement, the writ petition stands disposed of. There will be no order as to costs. (S.V.G., CJ.) (D.B.C., J.) 13.12.2023 Index :
