These applications have been filed to set aside the order of abatement caused due to the death of the second respondent and to bring on record the proposed respondents 6 to 9 as respondents 6 to 9 in the Original Petition.

2. Considering the nature of dispute between the parties, the delay has to be condone, the abatement is liable to be set aside and the proposed respondents 6 to 9 have to be recognized as the as legal heirs of the deceased second respondent, to advance substantive justice.

Accordingly, these applications are allowed. The applicant is directed to carryout amendment and file amended petition copy by 18.12.2023.
