This First Appeal is filed under Section 96 of CPC r/w under Order 41 Rule 1 of CPC, to set aside the Judgment and Decree made in O.S.No. 30 of 2018 before the III Additional District and Sessions Judge, Erode at Gobichettipalayam, dated 27.09.2022.

ORDER

Pending the Appeal, the parties have reached an amicable settlement and in this regard, the learned counsel for the appellants has filed affidavit dated 03.12.2025, in original, and the same is also placed for my perusal. The said

affidavit has been signed by the parties to the appeal viz., third appellant as well as the respondent. The affidavit discloses the fact that the parties have voluntarily settled the disputes amongst themselves and have therefore, sought for the settlement being recorded by this Court in the First Appeal proceedings.

2. In the light of the above, the First Appeal is dismissed as settled out of Court. No costs. Consequently, connected Miscellaneous Petition is also dismissed.
