ORDER
This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.
2. The case was registered in Cr.No.1 of 2008 dated 03.07.2008 for the alleged offence under Sections 3(1) and Sub Section 35(b) of the Tamilnadu Forest Act, 1967, Sections 36(a) and 36(e) of the Tamil Nadu Forest Act, 1882 and Sections 44 and 49(a) of the Amended Forest Act, 1992. The allegation in this case is that the accused was found transporting 19.200 kgs of Sandalwood logs worth Rs.6,720/- in an unregistered Bajaj Platina Motorcycle. It is reported that sandalwood logs were recovered. Further, it is submitted that accused No. 1 & 2 have been regularly attending the Court and the case is presently pending at the stage of warrant as against accused No.3. It is further submitted that the forest department has already filed an application for withdrawal of prosecution before the learned Magistrate which is currently pending.

3. Considering the factual matrix, context of the case and even considering the request for withdrawal of prosecution, allowing the case to remain on the file of the Magistrate would serve no useful purpose.
4. Accordingly, the case in C.C.No.100156 of 2009 on the file of Judicial Magistrate Court, Dharapuram, Dharapuram Taluk, Tirupur shall stand quashed and this Suo Motu Transfer Case stands disposed of. 17.10.2025 nsl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
