David Bharath Kumar v. The Secretary To Government
W.M.P.No.34421 of 2023 in W.P.No.22879 of 2023 Dr.ANITA SUMANTH, J.
After hearing the parties, this Court is not inclined, at this juncture, to consider or grant the interim prayer since it does not concern the prayer in main writ petition. The latter is for a mandamus directing the respondents to evolve a bye law in consonance with or simply adopt the model bye law under the Societies Registration Act, 1960.
2. The prayer in the application under consideration is one when the petitioner, who appears in person, seeks a stay of order dated 27.06.2023 passed by the Commissioner of Police, Traffic Zone, Vepery, Chennai in R.C.No.ESTT.III/Tr/557/11917/2023 removing the petitioner from the Traffic Warden Organization.
3. On a query put to the petitioner, he would accede to the position that order dated 27.06.2023 is not the subject matter of challenge at all. Hence, under these circumstances, the question of stay of that order does not arise. Hence, this WMP is dismissed.
4. Since pleadings are complete in the main writ petition, let the same be listed for hearing on 05.02.2024. 21.12.2023 ssm https://www.mhc.tn.gov.in/judis
