Respondents PRAYER : Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, forbearing the respondents or their men, agents from interfering with the peaceful contacts of treatments, i.e., cross massage in the name and style of "SNATURAL KERALA AYURVEDIC AND SPA" at Door No.176/6, II Floor, Indian overseas Bank upstairs, Near Venkateswara TVS Showroom, Annasalai, Rasipuram New Bus Stand, Rasipuram Taluk, Namakkal District - 637 408. For Petitioner : Mr.V.Perumal For Respondents : Mr.R.Govindasamy Special Government Pleader.

O R D E R

This petition has been filed in the nature of Writ of Mandamus, forbearing the respondents namely, the Superintendent of Police, Namakkal District, and Inspector of Police, Rasipuram, Namakkal District, from interfering with his peaceful contacts of the business under the name 'SNATURAL KERALA AYURVEDIC AND SPA'.

2. It is stated that the petitioner has made an arrangements to open Spa Centre at Door No.176C/6, II Fllor, Indian Overseas Bank upstairs, Near Venkateswara TVS showroom, Annasalai,

Rasipuram New Bus Stand, Rasipuram Taluk, Namakkal District.

3. It is stated by the respondents that obtaining a license is mandatory for running a Massage Parlour. For obtaining license necessarily there shall have to be a verification by the police.

4. Therefore, both the petitioner and respondents will have to follow the rules. The petitioner will have to apply for license. The respondents are an obligation to inspect, give a report to the District Collector, and the District Collector will have to pass orders. Consequently, the Writ Petition is disposed by giving liberty to the petitioner to apply for a license and direction to the respondents to act in accordance with the rules and for the District Collector to pass necessary orders.

5. With the above observations, this Writ Petition stands disposed of. No Costs. Consequently, connected Writ Miscellaneous Petition is closed.
