ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case in PRC.Nos.3 & 4 of 2023 was taken on the file of Page No.1 of 4

the Judicial Magistrate No.II, Krishnagiri Taluk, Krishanagiri for the alleged offence under Sections 363, 366, 376, 120(b) and 109 of IPC. There are totally 5 accused in this case and the case in respect of A1 to A4 was split up in S.C.Nos.87 and 88 of 2023 and the same has been disposed of.

3. On perusal of the allegations, it can be seen that a minor girl by name Bharathi, was taken away from the Tuition Centre. It seems to be the elopement on love affair. However, since the allegation of 376 of IPC is also made, the case is pending. The main case is in trial, where it can be seen that the mother of the victim and the victim turned hostile. The victim has given a statement that she doesn't want to pursue the case further.

4. Considering the over all facts and circumstances of the case and also the fact that it is in the guise of love affair; the victim girl has also now attained majority; she has moved to the marital life in a different family and if this case further proceeds, it would cause prejudice even to the victim, I am of the view that no useful purpose would be served in keeping this matter pending. 5.Accordingly, the case in PRC.Nos.3 & 4 of 2023 on the file of Page No.2 of 4

Judicial Magistrate No.II, Krishnagiri Taluk, Krishanagiri, stand quashed. This Suo Motu Transfer Cases are disposed of. 07.10.2025 mp electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
